This Privacy Policy describes how Forge & Wade LLC ("Company," "we," "us," or "our") collects, uses, stores, shares, and protects information in connection with the Brand Guide Creator platform at brand.aitoyteam.com (the "Platform"). By using the Platform, you consent to the practices described in this Privacy Policy.

This Privacy Policy is incorporated into and governed by our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

1. Information We Collect

1.1 Information You Provide Directly

Account Information

When you create an account, we collect:

  • Full name
  • Email address
  • Password (stored in encrypted form)

Purchase Information

When you make a purchase, we collect:

  • Payment information (processed by a third-party payment processor; we do not store credit card numbers)
  • Billing email address
  • Purchase history (date and amount of Initial Purchase and any Regeneration Purchases)

Interview Responses

During the Interview process, we collect:

  • Text responses you type into the Platform
  • If you choose the voice input option, audio of your spoken responses is transmitted directly to our third-party transcription provider (OpenAI's Whisper API) for transcription. We do not store the audio on our servers. We receive and store only the resulting text transcription. Audio retention is governed by OpenAI's own privacy policy (see Section 4.2).
  • Transcribed text generated from your voice recordings
  • Business and brand information you provide during the Interview, including but not limited to: business name, brand voice descriptions, target audience descriptions, positioning statements, values statements, and any other information you choose to share during the Interview

Generated Brand Guide

The Brand Guide produced from your Interview responses is stored on the Platform during your Access Window so you may download it. After the Access Window expires, the identifiable Brand Guide is removed from the Platform.

1.2 Information Collected Automatically

When you use the Platform, we automatically collect:

  • Log data (IP address, browser type, operating system, referring URLs, pages visited, date and time of access)
  • Usage data (interview progress, features used, time spent on the Platform, download events)
  • Device information (device type, screen resolution, unique device identifiers)
  • Cookies and similar tracking technologies (see Section 7)

1.3 Information from Third-Party Sources

We do not currently collect information about you from third-party sources beyond what is necessary to process your payment. Payment-related verification information may be received from our payment processor.

2. How We Use Your Information

To Operate the Platform, including but not limited to:

  • Create and manage your account
  • Process one-time payments and Regeneration Purchases through our third-party payment processor
  • Conduct the Interview using our AI systems
  • Transcribe voice recordings (if you select the voice input option)
  • Generate your Brand Guide using AI based on your Interview responses
  • Provide access to your Brand Guide during your Access Window
  • Track and enforce your Access Window

To Improve the Platform, including but not limited to:

  • Analyze usage patterns to improve features, interview flows, and brand guide outputs
  • Generate aggregated, anonymized Platform Data (as defined in our Terms of Service)
  • Train and improve our AI systems using aggregated, anonymized interaction data
  • Conduct internal analytics and research

To Generate Anonymized Trend Reports

We may use anonymized Interview responses, with all personally identifying and business-identifying information removed, to generate aggregated trend reports about brand voice patterns, audience patterns, positioning approaches, and category-level signals. These reports never identify any individual user, business, or specific Brand Guide.

To Communicate with You, including but not limited to:

  • Send account-related notifications (purchase confirmations, Brand Guide ready notifications, Access Window expiration warnings)
  • Respond to support inquiries at support@aitoyteam.com
  • Notify you of material changes to our Terms of Service or this Privacy Policy

To Ensure the Security of the Platform, including but not limited to:

  • Detect and prevent fraud or misuse
  • Monitor unauthorized access
  • Maintain operational integrity

For Legal and Compliance Issues, including but not limited to:

  • Enforce contracts and our Terms of Service or Privacy Policy
  • Defend against any claims made against us
  • Comply with applicable laws
  • Respond to legal or regulatory requests

3. How We Share Your Information

We share your information only in the following circumstances:

3.1 Third-Party Service Providers

We share information with trusted third-party service providers who process data on our behalf to operate the Platform. These include:

  • Payment Processors: We use a third-party payment processor to handle Initial Purchases and Regeneration Purchases. Your payment information (credit card number, expiration date, CVC) is transmitted directly to the payment processor and is not stored on our servers. The payment processor's own privacy policy governs their use of your data.
  • Cloud Hosting and Infrastructure Providers: Your account data, Interview responses, generated Brand Guides, and Platform data are stored on secure cloud infrastructure provided by third-party hosting services located in the United States.
  • AI Service Providers: We use third-party AI services to power the Platform's interview process, voice transcription, and brand guide generation features. Data sent to these providers is used solely for generating the requested output and is subject to the provider's data usage policies.
  • Voice Transcription Provider: If you use the voice input option, we use OpenAI's Whisper API to transcribe your voice recordings into text. Your audio is transmitted directly to OpenAI for processing. The Company does not store the audio on its own servers. OpenAI's use and retention of your audio is governed by OpenAI's own privacy policy, terms of service, and data usage policies. Per OpenAI's published data controls documentation, audio submitted to the Whisper transcription endpoint is not retained for abuse monitoring or as application state, and is not used to train OpenAI's models. Users who do not consent to this third-party processing should select the text input option instead.
  • Advertising Platforms: We may share limited data (such as hashed email addresses or site activity) with advertising platforms to deliver targeted ads and measure campaign performance. See Section 7 for more details on advertising cookies.

All third-party service providers are contractually obligated to use your information only as necessary to provide their services to us and to maintain appropriate security measures.

3.2 Legal Requirements

We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect the rights, property, or safety of the Company, our users, or the public.

3.3 Business Transfers

In the event of a merger, acquisition, or sale of all or substantially all of the Company's assets, your information may be transferred to the acquiring entity. The acquiring entity will be bound by the same obligations regarding your data as set forth in this Privacy Policy and our Terms of Service. We will notify you of any such transfer via email or prominent notice on the Platform.

3.4 Aggregated and Anonymized Data

We may share aggregated, anonymized Platform Data that does not identify any individual user. This data may be shared with industry partners, trade organizations, researchers, and the public, including in the form of trend reports. See our Terms of Service (Section 6.2) for details on Platform Data.

4. Data Storage and Security

4.1 Where We Store Your Data

Your data is stored on secure cloud infrastructure provided by third-party hosting services. Servers are located in the United States. Generated Brand Guides are stored in secure storage with access restricted to authenticated users and authorized Company systems.

4.2 Voice Recording Processing

The Company does not store voice recordings on its own servers. When you use the voice input option, your audio is transmitted directly to our third-party transcription provider, OpenAI's Whisper API, for the sole purpose of generating a text transcription. The Company receives and stores only the resulting transcription.

OpenAI's use, processing, and retention of your audio is governed by OpenAI's own privacy policy, terms of service, and data usage policies. Per OpenAI's published data controls documentation, audio submitted to the Whisper transcription endpoint is not retained for abuse monitoring or as application state, and is not used to train OpenAI's models. OpenAI may update its data handling practices at any time, and current details can be found in OpenAI's published documentation.

If you do not consent to this third-party processing of your voice data, you should select the text input option instead. The text input option does not involve transmission of any audio data to a third-party provider.

4.3 Security Measures

We implement reasonable administrative, technical, and physical safeguards to protect your information, including:

  • Encrypted data transmission (HTTPS/TLS) for all Platform communications
  • Encrypted password storage
  • Access controls on stored Brand Guides and account data
  • Authentication-based access to user data through the Platform's API

No method of transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

4.4 Data Retention

We retain your information for as long as your account is active or as needed to provide the Platform's services. Specifically:

  • Account information is retained for the duration of your account and deleted upon account termination, subject to the exceptions below.
  • The Company does not store voice recordings on its own servers. Audio is transmitted to a third-party transcription provider (OpenAI's Whisper API) and is subject to that provider's retention practices (see Section 4.2).
  • Interview responses (text and transcribed) are retained during your Access Window. After the Access Window expires, identifiable Interview responses are anonymized.
  • Generated Brand Guides are retained on the Platform during your Access Window (six months from generation), then removed.
  • Payment records are retained as required by applicable tax and financial regulations.
  • Aggregated, anonymized Platform Data may be retained indefinitely, as it does not identify individual users.

After account termination, we may retain certain data for a limited period as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.

5. Your Rights and Choices

5.1 Access and Export

You may access your account information through your account settings on the Platform. You may download your generated Brand Guide directly from the Platform during your Access Window. You may request a copy of your Interview responses or other personal information by contacting support@aitoyteam.com.

5.2 Correction

You may update or correct your account information at any time through your account settings or by contacting support@aitoyteam.com.

5.3 Deletion

You may request deletion of your account and personal information by contacting support@aitoyteam.com. Upon receiving a verified deletion request, we will delete your personal information within 45 days, except where retention is required by law or for legitimate business purposes (such as retaining payment records for tax compliance). Aggregated, anonymized Platform Data derived from your usage may be retained as described in our Terms of Service.

5.4 Opt-Out of Communications

You may opt out of non-essential communications (such as product updates or tips) by using the unsubscribe link in any email. You cannot opt out of essential account communications (such as purchase confirmations, security alerts, Access Window expiration notices, or Terms/Privacy Policy changes).

6. State Privacy Rights

6.1 New Jersey Residents

Under the New Jersey Data Privacy Act (effective January 2025), New Jersey residents have the right to: access their personal data, correct inaccuracies, delete their personal data, obtain a copy of their data in a portable format, and opt out of the sale of personal data, targeted advertising, and profiling. To exercise these rights, contact support@aitoyteam.com.

6.2 California Residents

Under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), California residents have additional rights regarding their personal information:

  • Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of collection, the business purposes for collection, and the categories of third parties with whom we share your information.
  • Right to Delete: You may request deletion of your personal information, subject to certain exceptions.
  • Right to Opt Out of Sale or Sharing: We do not sell personal information in the traditional sense. However, certain data sharing with advertising platforms for targeted advertising purposes may be considered "sharing" under the CCPA/CPRA. You may opt out of this sharing by contacting support@aitoyteam.com or adjusting your cookie preferences.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

6.3 Other State Residents

Residents of states with comprehensive privacy laws (including Colorado, Connecticut, Virginia, and others) may have similar rights to access, correct, delete, and port their personal data. 7. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the Platform and to support our marketing efforts. Specifically:

  • Essential Cookies: Required for the Platform to function, including authentication cookies that keep you logged in and session cookies that maintain your state during use. These cannot be disabled.
  • Analytics Cookies: Used to understand how users interact with the Platform, which features are most used, and where users encounter issues. This data is used to improve the Platform.
  • Advertising and Retargeting Cookies: We may use tracking technologies from third-party advertising platforms (such as Meta/Facebook Pixel, Instagram, Google Ads, and similar services) to serve targeted advertisements to you on other websites and social media platforms. These technologies may collect information about your activity on the Platform to deliver relevant ads and measure ad performance. You can opt out of targeted advertising through the settings of the respective advertising platforms, through your browser settings, or by contacting us at support@aitoyteam.com.

Most web browsers allow you to control cookies through their settings. Disabling essential cookies may prevent you from using the Platform. Disabling advertising cookies will not affect your ability to use the Platform but may result in less relevant ads on other sites.

8. AI Data Processing

The Platform uses artificial intelligence to process your data for the following purposes:

  • Conducting the Interview, including generating questions and follow-up questions based on your responses
  • Transcribing voice recordings into text (if you use the voice input option)
  • Generating your Brand Guide based on your Interview responses

When the Platform sends data to our AI service providers for processing, the data transmitted includes your Interview responses (text and transcribed) and any business or brand information you have provided. This data is sent solely for the purpose of generating the requested output (interview questions, transcription, or Brand Guide).

Aggregated, anonymized interaction data may be used to train and improve the Platform's AI systems over time, as described in our Terms of Service (Section 6.3).

9. Children's Privacy

The Platform is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information. If you believe a child has provided us with personal information, please contact support@aitoyteam.com.

10. Third-Party Links and Services

The Platform may contain links to third-party websites, including payment processors and other related sites. We are not responsible for the privacy practices of these third-party sites. We encourage you to read the privacy policies of any third-party site you visit.

11. International Users

The Platform is operated from the United States and is intended for use by U.S.-based users. If you access the Platform from outside the United States, you consent to the transfer of your information to the United States, where data protection laws may differ from those in your jurisdiction.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email or through a prominent notice on the Platform at least 30 days before taking effect. Your continued use of the Platform after changes become effective constitutes acceptance of the updated Privacy Policy.

We encourage you to review this Privacy Policy periodically.
